The data we collect about you
Personal data means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer different kinds of personal data about you, grouped as follows:
- Identity Data: first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.
- Contact Data: billing address, delivery address, email address and telephone numbers.
- Financial Data: bank account and payment card details.
- Transaction Data: details about payments to and from you and other details of products and services you have purchased from us.
- Technical Data: IP address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
- Profile Data: purchases or orders made by you, your interests, preferences, feedback and survey responses.
- Usage Data: information about how you use our website, products and services.
- Marketing and Communications Data: your preferences in receiving marketing from us and our third parties and your communication preferences.
We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as it does not directly or indirectly reveal your identity. If we combine Aggregated Data with your personal data so that it can identify you, we treat the combined data as personal data.
We do not collect Special Categories of Personal Data about you (including details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health, or genetic and biometric data). Nor do we collect information about criminal convictions and offences via this website.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In that case we may have to cancel a service you have with us, but we will notify you if this is the case at the time.
How your personal data is collected
We use different methods to collect data from and about you, including through:
- Direct interactions: you may give us Identity, Contact and Financial Data by filling in forms or corresponding with us by post, phone, email or otherwise — including when you apply for our services, subscribe to publications, request marketing, enter a survey or give us feedback.
- Automated technologies: as you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns using cookies, server logs and similar technologies.
- Third parties or publicly available sources: we may receive personal data from analytics providers, advertising networks, search information providers, providers of technical, payment and delivery services, and publicly available sources such as Companies House and the Electoral Register.
How we use your personal data
We will only use your personal data when the law allows us to. Most commonly we will use it where we need to perform the contract we are about to enter into or have entered into with you; where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; or where we need to comply with a legal or regulatory obligation.
Generally we do not rely on consent as a legal basis for processing your personal data other than in relation to sending third-party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by emailing admin@apexsolicitors.co.uk or telephoning 020 7635 6160.
Purposes for which we will use your personal data
We use your personal data to register you as a client; to manage our relationship with you, including notifying you of changes to our terms and privacy policy and asking you to leave a review; to administer and protect our business and this website (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data); to use data analytics to improve our website, services, marketing, customer relationships and experiences; and to make suggestions and recommendations to you about services that may be of interest.
We may process your personal data for more than one lawful ground depending on the specific purpose. Please contact us if you need details about the specific legal ground we are relying on where more than one ground applies.
Marketing
We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you.
You will receive marketing communications from us if you have requested information from us or purchased services from us, or if you provided us with your details as part of a survey and, in each case, you have not opted out of receiving that marketing.
We will get your express opt-in consent before we share your personal data with any company outside Apex Solicitors for marketing purposes. You can ask us to stop sending you marketing messages at any time by contacting us. Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a service purchase or other transactions.
Cookies
You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, some parts of this website may become inaccessible or not function properly.
Change of purpose
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason that is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. We may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
Disclosures of personal data
We may have to share your personal data with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, the new owners may use your personal data in the same way as set out in this privacy notice.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process it for specified purposes and in accordance with our instructions.
International transfers
We do not transfer your personal data outside the European Economic Area (EEA) from our website.
Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and are subject to a duty of confidentiality. We have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
Data retention
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and the applicable legal requirements.
Your legal rights
You have the right to request access to your personal data; to request correction of the personal data we hold about you; to request erasure of your personal data where there is no good reason for us continuing to process it; to object to processing where we are relying on a legitimate interest or processing for direct marketing; to request restriction of processing in certain scenarios; to request the transfer of your personal data to you or a third party; and to withdraw consent at any time where we are relying on consent to process your personal data.
We may charge a reasonable fee (a maximum of £10) if your request is clearly unfounded, repetitive or excessive, or we may refuse to comply with your request in those circumstances. We may need to request specific information from you to help us confirm your identity. We try to respond to all legitimate requests within one month. Occasionally it may take longer if your request is particularly complex or you have made a number of requests, in which case we will notify you and keep you updated.
External third parties
Professional advisers acting as processors or joint controllers, including lawyers, bankers, auditors and insurers based in the UK who provide consultancy, banking, legal, insurance and accounting services. HM Revenue & Customs, regulators and other authorities based in the UK who require reporting of processing activities in certain circumstances.
